When you buy a home, your mortgage lender will require a title search — a comprehensive look at legal records for both the property and the property's current owner.
The goal is to make sure that the seller is the legal owner of the home and that there are no outstanding issues or liens on the property that would prevent the seller from legally transferring the home to you. The title search takes place after you have made the offer on the home, but before closing.
There are two steps when conducting a title search for property purchases: examining public records and identifying any legal or financial claims against the property. Here's how those steps work.
The first step is to pull any public records for the property. These include deeds, leases, contracts, legal notices, zoning violations, maps, land surveys, easements, and more. This helps establish who the rightful owner of the property is, as well as its legal boundaries and limitations.
A title search will also look for legal judgments against the property (or the property's owner) and potential liens. Liens are claims that are placed on a property because of an unpaid debt. They can stem from unpaid contractor bills, property taxes, HOA dues, and more.
The importance of title search in real estate cannot be stressed enough. These are vital steps in the homebuying process. Not only do they ensure a property can transfer seamlessly to a new owner, but mortgage lenders also require them.
In order for someone to sell a property, they have to be the legal owner of it. That's where a title search comes in, establishing a chain of ownership and ensuring the person selling the home has the current rightful owner in the eyes of the law.
Liens and encumbrances are important to uncover, as they could put the home at risk of foreclosure if the creditor comes calling. You'll want to resolve these before moving forward with your purchase.
Identifying easements is critical, too. These can limit how you can use your property, as well as how it can be used and accessed by third parties. They may impact how you can renovate your house later on, too.
Your lender will order a title search on any property you intend to buy. Depending on where you're purchasing, this may be done by one of two parties: a title company or an attorney.
Title companies specialize in the title search process. They do title searches and often provide title insurance, which protects you and your lender if someone else tries to claim the property. Sometimes, they also handle the closing process, so you may visit your title company to sign your papers and pay your closing costs.
In some states, attorneys handle the title search process. They may also be present at closing as you sign your final documents.
While you may be able to access public records on your own, it's best to leave title searches to professionals. They're trained not only to identify the proper documents to evaluate in a title search, but also to spot potential issues that could pose a legal or financial problem once you own the home.
Title searches can uncover any number of issues, particularly if a home is older and has a long line of past owners. Here's what you should watch out for:
A title search might find that there are unpaid mortgage loans on the property or liens against the house. These liens can stem from any number of unpaid debts, including property taxes or even bills from contractors who repaired the house at some point. (Essentially, the unpaid party has a right to sell the house and use the proceeds to collect on the debt.)
Sometimes, current and past land surveys can contradict each other, showing different boundaries for the property. This may mean a neighbor or other party could lay claim to part of the land.
Title searches may also reveal easements, which give other parties certain rights to your property. It could give a utility company the right to access your yard for repairs or equipment maintenance, or it might grant your neighbor the ability to pass through your property to access a public road. There are also easements that can limit what you do with your property. (For example, you may not be able to add that additional story if it would block your neighbor's views.)
What happens next depends on the outcome of the title search. If the search revealed any claims against the property or easements, you'll need to address those before moving forward. If the title search was clean, you can proceed with your purchase.
The first step is resolving issues found in the title search. If there were any liens, boundary disputes, or legal encumbrances identified by the title search, you'll need to decide who is financially responsible for taking care of those. The seller can take care of them or compensate you for dealing with them yourself. You can also split the costs, or you may be willing to take on costs such as unpaid property taxes. If you can't reach an agreement with the seller, you'll probably want to back out of buying the house.
If the title search results are severe, your lender won't approve the mortgage. For example, maybe there is a lien on the home because the seller hasn't been making mortgage payments and their lender is going to foreclose. In this case, it's unlikely your lender will approve the loan.
If your title search was clean, you can move forward with your home purchase. Your lender will begin underwriting and processing your loan, and you'll be given a scheduled closing date. This is when you will finalize the transaction, sign all the legal documents, and pay your closing costs.

Damian Williams, the United States Attorney for the Southern District of New York, announced that KONRAD BICHER was sentenced today by U.S. District Judge Lorna G. Schofield to 51 months in prison in connection with his fraudulent operation of real estate businesses, including by entering into lease agreements for residential apartment units in Manhattan on false and fraudulent pretenses and by making false statements to obtain loans guaranteed by the U.S. government. BICHER previously pled guilty to one count of wire fraud in connection with the scheme.
U.S. Attorney Damian Williams said: “For years, Bicher schemed to defraud New York City landlords and the U.S. Government. Bicher enriched himself by abusing Government programs and tenant protections intended to benefit people and businesses in need during one of the worst economic and public health crises in history. He bragged about his schemes to his friends and the media, proudly referring to himself as the ‘Wolf of Airbnb,’ but as today’s sentence underscores, those who partake in such callous and fraudulent conduct will answer for their crimes, no matter their self-given title.”
According to the allegations in the Complaint, Indictment, other court documents, and statements made in Court:
Beginning in at least February 2019, BICHER and/or individuals working in concert with BICHER, began renting apartment units (the “Units”) in Manhattan. The Units were leased pursuant to lease agreements which required that the lessee make monthly rental payments and also included clauses that prohibited the lessee from renting the Units to third parties on a short-term basis and/or included clauses that prohibited the lessee from subletting the Units to third parties without written consent of the owner. Despite the requirement to make monthly rental payments, BICHER failed to make payments as required by the lease agreements. For many of the Units, BICHER also refused to vacate the Units after the expiration of the lease agreements. During the period of time that BICHER failed to make required rental payments, including the period of time after a lease agreement expired and the premises had not been vacated, BICHER derived income by renting the Units on a short-term basis, including by posting the Units for rent on various online marketplaces, including Airbnb, Inc. (“Airbnb”).
Between in or about July 2019, and in or about April 2022, BICHER and his associates failed to make more than $1,000,000 in payments pursuant to the Lease Agreements or, for the period of time after the expiration of the Lease Agreements, based on the estimated fair market value for the Units. During this period, BICHER caused the Units to be listed for short-term rent on Airbnb and at least one other online marketplace for short-term rentals, resulting in at least $1,170,000 in rental income to BICHER and his associates.
Throughout the course of this scheme, the lessors of the Units made numerous efforts to recover rental payments from BICHER and/or to stop BICHER from continuing to rent the Units on a short-term basis, including by initiating civil litigation against BICHER. BICHER relied on legal protections intended to benefit tenants, including tenant protections adopted in connection with the COVID-19 pandemic, in order to oppose the lawsuits. Despite relying on tenant protections for New Yorkers in need, BICHER continued to generate revenue by renting certain Units on a short-term basis.
In addition, between at least in or about April 2021, until in or about July 2021, BICHER obtained Government-guaranteed loans through a loan program of the U.S. Small Business Administration designed to provide relief to small businesses during the COVID-19 pandemic, namely the Paycheck Protection Program (“PPP”). In furtherance of this scheme, BICHER submitted at least four applications for PPP loans on behalf of at least three entities and obtained over $565,000 in loan proceeds. These PPP applications contained fraudulent documents and false information. For example, in connection with the PPP applications, BICHER submitted tax documents which were purportedly filed with the Internal Revenue Service (“IRS”). These documents were falsified, in that the entities seeking PPP loans had not actually filed the purported tax returns with the IRS, and BICHER had not otherwise reported the purported income to the IRS.
During the course of the scheme, BICHER referred to himself as the “Wolf of Airbnb” and explained to media outlets that this nickname referred to the fact that he was “hungry and ruthless enough to get on top of the financial ladder” and had the “ferocity…of a wolf, because wolves are territorial, vicious, and show no mercy when provoked.”

In addition to the prison term, BICHER, 32, of Hialeah, Florida, was sentenced to three years of supervised release. He was additionally ordered to forfeit $1,740,407.12 and pay restitution in the amount of $2,227,371.58.
Mr. Williams praised the outstanding investigative work of the Federal Bureau of Investigation.
This case is being handled by the Office’s General Crimes Unit. Assistant U.S. Attorney Matthew Weinberg is in charge of the prosecution.

The Emma Hayes era officially got under way Thursday, with the U.S. beating Zambia 3-0 on the opening day of the women’s soccer tournament at the Paris Olympics in a game that was far more one-sided than the final score.
Playing on the French Rivera in steamy Nice, wedged between the Mediterranean Sea and the French Alps, the Americans dominated in their new coach’s first competitive game on the sidelines, getting two goals from Mallory Swanson, another from Trinity Rodman and two assists from captain Lindsay Horan — all in the first 25 minutes.
There were few witnesses to any of that since the match drew a gathering so small, players could be heard shouting to one another from the top deck of Allianz Riviera Stadium. Nor, given the quality of the opponent — Zambia is ranked 64th in the world, worst in the Olympic field — were there many conclusions that could be drawn from the result.
But it was a good start for a team trying to erase the memory of last summer’s World Cup, where the U.S. bowed out short of the semifinals for the first time. That led to Vlatko Andonovski’s firing , Hayes’ hiring and the start of what U.S. Soccer hopes will be a new chapter in the program’s storied history.
“We’re all really starting to come around to the way Emma has wanted us to play, the principles, and it’s been really enjoyable just being able to learn different things and trying to apply them,” Swanson said.
“It’s a good start. But there’s little things within that game, within the play, that we just need to fine-tune.”
Rodman agreed.
“We have a lot to prove to ourselves. So yeah, going off this game, I’m so happy about the performance, but there’s still a lot of room for improvement.”
Especially since the road ahead gets much tougher with the U.S. facing fourth-ranked Germany and No. 12 Australia in its final group-play matches. The Americans are fifth in the latest FIFA world rankings, their lowest ranking ever.

The first-round of the Olympic tournament is extremely forgiving with eight of the 12 teams — the top two in each of three groups, plus the two best third-place teams — going through to the quarterfinals. With Thursday’s win, the Americans should clear that low bar easily.
The real challenge is what comes after that. With No. 2 France, the Olympic host; top-ranked Spain, the reigning world champion; and Canada, the defending Olympic champion; in the field along with Germany, there will be no easy games in the knockout rounds.
Nor will there be any room for error for Hayes.
After reaching the gold-medal match of the first five Olympics, winning four of them, the U.S. has gone 12 years without playing for a title in the Summer Games. And if it doesn’t make it back to the top of the medal podium this summer that result, combined with last summer’s World Cup debacle, will mark the first time the Americans have gone a full four-year cycle without winning a major international championship.
Hayes’ job is to make sure that doesn’t happen and her team came out flying Thursday, peppering the Zambian goal from the start. But it couldn’t find the back of the net until the 17th minute when Rodman took a pass from Horan at the top of the box, spun to her right to escape two defenders, her long pink dreadlocks whipping around with her, then slipped a low right-footed shot past keeper Ngambo Musole to give the U.S. the only goal it needed.
It wasn’t the only one the Americans scored though, with Swanson adding two more 70 seconds apart to make it 3-0 eight minutes later. Eight minutes after that Zambia lost defender Pauline Zulu to a red card, leaving it short-handed the rest of the way. But even though the U.S. had a 27-8 edge in shots, it didn’t score again, leaving Hayes with some work to do before her team meets Germany on Sunday.

“The first part of the first half was exceptional,” she said. “To come out the way we did, the intention, the intensity, the decision-making, the execution, it should have been at least 5-0 at halftime. There was things within our structure I didn’t like. But that’s easy fixes.
“If we had asked me at the beginning of the game ‘would you be happy with a 3-0 winner?’ I probably would have said no. However, for the performance and the chances created and finding the back of the net, I don’t want to be too hard on the players.”

The early-morning raid took place on Long Island’s North Shore at the house of Ms. Hochul’s former deputy chief of staff, Linda Sun.

Before dawn on Tuesday, F.B.I. agents swept into a small cul-de-sac on Long Island’s North Shore to search a five-bedroom house where a former deputy chief of staff to Gov. Kathy Hochul lives with her husband.
The basis for the search at the $3.5 million home of Linda Sun, the former deputy chief of staff, and the crimes under investigation remain unclear. Neither Ms. Sun, 40, nor her husband, Chris Hu, 41, have been accused of wrongdoing. Neither could be reached for comment and they did not respond to voice mail and text messages.
A spokesman for the F.B.I. confirmed that agents from the bureau’s New York office had “conducted court-authorized law enforcement activity” at the expansive red brick house in a gated community in Manhasset, but would not comment further. The U.S. attorney’s office in Brooklyn obtained the warrant for the search, according to people with knowledge of the matter; a spokesman for that office also declined to comment.
No arrests were made at the family’s home, according to a person familiar with the investigation. The property was owned by Ms. Sun and Mr. Hu until they transferred it to a trust early this year.
Ms. Sun, who earned a Bachelor of Arts degree in political science and government from Barnard College and a Master of Arts from Teachers College at Columbia University, has worked in state government for nearly 14 years, holding a variety of positions, according to her LinkedIn profile.
She began her state career in the legislative branch as chief of staff to an assemblywoman, Grace Meng, who is now a congresswoman, and then worked in various positions in the administrations of both Gov. Andrew M. Cuomo and Ms. Hochul, according to the profile.
Ms. Sun’s roles included business development; Asian American affairs; and diversity, equity and inclusion. She left the executive chamber after roughly 15 months, moving on to a position in the Labor Department in November 2022. Five months later, she left the state to serve as campaign manager for Austin Cheng, a Democrat who made an unsuccessful bid for Congress on Long Island.
Avi Small, the press secretary for Ms. Hochul, declined to comment.
Mr. Hu operates a liquor store in Flushing, Queens, Leivine Wine & Spirits, and has incorporated several other businesses over the last decade, including a company he created in 2020 during the earliest days of the coronavirus pandemic called Medical Supplies USA LLC. He also created Golden Capital Group LLC in 2016 and LCA Holdings LLC in 2023, although the nature of those businesses could not be immediately determined.
It is unclear when the F.B.I. agents first arrived at the gated community where Ms. Sun and Mr. Hu live, which is called Stone Hill, but a security guard there said that agents were there twice.

It’s a blueprint for what a second Trump administration could look like, dreamed up by his allies and former aides.
If Donald Trump struggled somewhat in his first administration to move the country dramatically to the right, he’ll be ready to go in a second term.
That’s the aim behind Project 2025, a comprehensive plan by former and likely future leaders of a Trump administration to remake America in a conservative mold while dramatically expanding presidential power and allowing Trump to use it to go after his critics.
The plan is gaining attention just as Trump is trying to moderate his stated positions to win the election, so he’s criticized some of what’s in it as “absolutely ridiculous and abysmal” and insisted that neither he nor his campaign had anything to do with Project 2025.
Still, what’s in this document is a pretty good indicator of what a second Trump presidency could look like. Here’s what Project 2025 is and how it could reshape America.
The centerpiece is a 900-page plan that calls for extreme policies on nearly every aspect of Americans’ lives, from mass deportations, to politicizing the federal government in a way that would give Trump control over the Justice Department, to cutting entire federal agencies, to infusing Christian nationalism into every facet of government policy by calling for a ban on pornography and promoting policies that encourage “marriage, work, motherhood, fatherhood, and nuclear families.”
This isn’t coming directly from the Trump campaign. But it should be taken seriously because of the people who wrote it, analysts say. The main organization behind the plan, the Heritage Foundation, is a revolving door for Trump officials (and Heritage is a sponsor of the Republican National Convention, which will hand him the nomination next week).
“This is meant as an organized statement of the Trumpist, conservative movement, both on policy and personnel, and politics,” said William Galston, head of governance studies at the Brookings Institution.
A few of the highlights:
Remake the federal workforce to be political : Instead of nonpartisan civil servants implementing policies on everything from health to education and climate, the executive branch would be filled with Trump loyalists. “It is necessary to ensure that departments and agencies have robust cadres of political staff,” the plan says. That means nearly every decision federal agencies make could advance a political agenda — as in whether to spend money on constituencies that lean Democratic. The project calls for cutting LGBTQ health programs, for example.
Cut the Education Department: Project 2025 would make extensive changes to public schooling, cutting longtime low-income and early education federal programs like Head Start, for example, and even the entire Education Department. “Federal education policy should be limited and, ultimately, the federal Department of Education should be eliminated,” the plan reads.
Give Trump power to investigate his opponents : Project 2025 would move the Justice Department, and all of its law enforcement arms like the FBI, directly under presidential control. It calls for a “top-to-bottom overhaul” of the FBI and for the administration to go over its investigations with a fine-toothed comb to nix any the president doesn’t like. This would dramatically weaken the independence of federal law enforcement agencies. “There’s going to be an all-out assault on the Department of Justice and the FBI,” said Galston, of Brookings. “It will mean tight White House control of the DOJ and FBI.”
Make reproductive care, particularly abortion pills, harder to get : It doesn’t specifically call for a national abortion ban, but abortion is one of the most-discussed topics in the plan, with proposals throughout encouraging the next president “to lead the nation in restoring a culture of life in America again.” It would do this by prosecuting anyone mailing abortion pills (“Abortion pills pose the single greatest threat to unborn children in a post-Roe world,” the plan says). It would raise the threat of criminalizing those who provide abortion care by using the government to track miscarriage, stillbirths and abortions, and make it harder to get emergency contraceptive care covered by insurance. It would also end federal government protections for members of the military and their families to get abortion care.
Crack down on even legal immigration : It would create a new “border patrol and immigration agency” to resurrect Trump’s border wall, build camps to detain children and families at the border, and send out the military to deport millions of people who are already in the country illegally ( including dreamers ) — a deportation effort so big that it could put a major dent in the U.S. economy. “Illegal immigration should be ended, not mitigated; the border sealed, not reprioritized,” the plan says.
Slash climate change protections : Project 2025 calls for getting rid of the National Oceanic and Atmospheric Administration, which forecasts weather and tracks climate change, describing it as “one of the main drivers of the climate change alarm industry.” It would increase Arctic drilling and shutter the Environmental Protection Agency’s climate change departments, all while making it easier to up fossil fuel production.
Ban transgender people from the military and consider reinstating the draft : “Gender dysphoria is incompatible with the demands of military service,” it reads. The author of this part of the plan led the Defense Department at the end of Trump’s presidency, and he told The Washington Post that the government should seriously consider mandatory military service.
A huge part of this project is to recruit and train people on how to pull the levers of government or read the law in novel ways to carry out these dramatic changes to federal policy. There’s even a place on the plan’s website where you can submit your résumé.
But there are some major hurdles to getting the big stuff done, even if Trump and Republicans win control of Washington next year. For one, Trump doesn’t appear to agree with everything in it. His campaign platform barely mentions abortion, while Project 2025 zeroes in on it repeatedly.
Also, some of these ideas are impractical or possibly illegal. Analysts are divided about whether Trump can politicize the civil workforce to fire them at will, for example. And the plan calls for using the military to carry out mass deportations on a historic scale , which could be constitutionally iffy.
Ominously, one of the project’s leaders opened the door to political violence to will all of this into being: “We are in the process of the second American revolution,” Heritage Foundation President Kevin Roberts warned recently, “which will remain bloodless, if the left allows it to be.”
It’s not unusual for wannabe administration officials to plan for how they’d govern once they get back in power. But what is unusual is how dramatic and unapologetically extreme many of these proposals are.
And the Biden campaign — which is obviously struggling right now with existential questions about its nominee — sees this as an easy target to campaign on.
Democrats are circulating a survey from a liberal organization that suggests talking about Project 2025 as a “takeover” of American government by Trumpists resonates with voters.
“It’s like reading a horror novel,” said Democratic strategist Jesse Ferguson. “Each page makes you want to read the next one, but when you finish reading it, you’re scared and disgusted.”
That’s much to the frustration of the Trump campaign, which doesn’t want such specific (and politically unpopular) ideas out there pegged to his campaign, as he’s trying to moderate some of his positions to win the election.
“It makes no sense to put all the crazy things you’ll be attacked for down on paper while you’re running,” a Trump adviser told The Washington Post recently .
But it’s fair to think of Project 2025 as a pretty good indicator of what a second Trump presidency would look like, analysts say.
“It’s not like Trump is going to hand out this booklet to his Cabinet on Day One and say, ‘Here you go,’” said Michael Strain, the director of economic policy studies at the conservative-leaning American Enterprise Institute. “But it reflects real goals of important people in Trump’s community.”
