Abstract: The Electronic Commerce (e-Commerce) Act of 2000 or Republic Act (RA) No. 8792 mandates all government agencies to transact business and perform government functions using electronic documents within two years from the date of its effectivity in June 2000. Unfortunately, only a handful of government agencies were ready to implement the said law in the year 2002 despite the availability of applicable information technology (IT) resources and appropriated budget. After 17 years, there is considerable improvement in the compliance with the said law, though there are still non-compliances of government offices that could not manage to be at par with leading compliant government offices. To understand the compliance behavior of an agency vis-a-vis the e-Commerce Act, I proceed in three steps. First, I adopted socio-economic theory on regulatory compliance Next, I use process pattern matching as a qualitative approach to examine the compliance variables by comparing the case-based empirical patterns with the operational framework. And third, I statistically test the hypotheses that organizational commitment and the organizational maturity on the use of IT impact the level of compliance. I do this by using case study method by combining the qualitative and quantitative analyses of the compliance behavior of the Bureau of Internal Revenue and the Commission on Elections Thus, this paper contributes to the theorization of regulatory compliance in understanding organizational commitment with electronic commerce and related laws involving the use of IT in the Philippine context with detailed elucidation of the variables influencing it.

Regulation is the most direct and predictable mechanism for controlling environmental behavior. Strong compliance and enforcement programs that punish violators and deter violations by others are, of course, essential to any successful regulatory system. It is increasingly clear, though, that regulation cannot by itself produce the behavioral changes needed to achieve sustainable environmental outcomes. The nature of environmental challenges has undergone such a fundamental change that the existing regulatory-focused system of environmental governance cannot ensure healthy air, clean water, a stable climate, safe drinking water, vital ecosystems, and continuing biodiversity. Rather, sustainability will also require better alignment of economic drivers with environmental goals and changes in societal values.1

Due to its remarkable success, the model of the Montreal Protocol’s non-compliance procedure (NCP) has been adopted in other environmental regimes, whose primary norms differ considerably. Hence, this article distinguishes different types of global environmental regimes and assesses the performance of NCPs therein as endogenous enforcement mechanisms. In fact, the reciprocal nature of the main conventional obligations in some more recent environmental regimes seems to hamper the effectiveness of compliance procedures. On this basis, the article puts forward some tentative considerations from a constitutional perspective. Drawing from the experience gained under environmental regimes in the region of the United Nations Economic Commission for Europe (UNECE), it explores the feasibility of transplanting some aspects of the model of the Aarhus Convention NCP into the more complex global context. Further, it reflects upon the potential of enhancing synergies between NCPs and national and international judiciaries as a step towards the consolidation of international public law in this area.

This article intends to treat the Compliance Program as a way to combat environmental problems. Thus, the central issue is the following question: is it possible to address environmental problems through the implementation of the Compliance program? To solve this issue, the main objective of the article is to analyze the role of Compliance in addressing environmental problems. And specific objectives are to study environmental law in globalization and the concept of compliance. Therefore, the article was divided into three topics, the first dealing with Environmental Law in the Globalization era, the second on Compliance and the third on Compliance as an instrument to prevent environmental problems, where Environmental Compliance was analyzed in more detail. which are used by companies and public bodies to comply with environmental standards. As for the Methodology, the report of the results will be composed on the Inductive Logical basis. In the various phases of the Research, the Referent Techniques, Category, Operational Concept and Bibliographic Research will be used.

Many industrial practices, such as the organization of working conditions or the use of hazardous substances, are no longer endemic to a specific jurisdiction. Rather, they spread through cross-border production chains or global markets for consumer products. In many cases, such regulatory issues therefore cannot be resolved within a single territory. Instead, they require the involvement of global players, such as civil society, business actors or international organizations, who can often find pragmatic solutions to global problems, even if they lack the formal authority to do so. This seems to conform to a more global trend of national government getting replaced by global governance.
